Who can claim?
Only Australian residents who are aged 18 or over are invited by the Promoter to participate in this promotion.
Who can’t enter?
Directors, officers, management, and employees (and their immediate families) of:
(a) the Promoter; and
(b) the agencies, companies or participating premises associated with this promotion.
Offer Period:12.01am (AEDT) on 22/03/2023 to 11.59pm (AEDT) on 24/03/2023.
Venue: The offer will run in a liquor-licensed venue
Claim instructions:
To claim your gift within the specified Offer Period, you must complete the following steps:
(a) Accept the invitation from the Promoter to participate in the offer;
(b) Access the designated webpage, fill out and submit the online entry form to receive a voucher code for use at a participating Venue;
(c) Visit the designated Venue before the end of the promotion period, enter the voucher code into Chewzie when placing your order, and claim your gift.
The adequacy of your mobile device for submitting a claim on Chewzie is not the responsibility of the Promoter.
What gift can I claim?
Each valid claim is entitled to a gift. Each gift is 1 bottle of Stone and Wood Ale. The total prize pool of gifts for this offer is limited to 200. Once the total number of gifts awarded reaches 200, no additional gifts will be offered as part of this promotion.
How many times can I claim?
While stocks last, each person is allowed to claim only one gift.
Collection and use of your personal information:
The collection of your personal information by the Promoter may occur through its agents or contractors. Your personal information will be used by the Promoter to manage and conduct the promotion. Additionally, the Promoter may disclose your personal information to its related companies, agents, and contractors to assist with communication, data storage, or conducting the promotion.
If you enter the promotion, you agree that the Promoter can store your personal information in its database for future marketing purposes, which may include contacting you through electronic messaging. However, the Promoter will include a functional unsubscribe option in each direct marketing communication it sends you, as required by the Spam Act 2003 (Cth), that you can use to opt-out of further communications.
Information regarding seeking access to and correcting personal information held by the Promoter, as well as making a complaint about a privacy breach and how the Promoter will address such a complaint, can be found in the Promoter’s Privacy Policy, which can be accessed at https://chewzie.me/privacy/.
Claim
To have your claim considered, it must be submitted during the Offer Period and will only be deemed received by the Promoter upon its actual receipt.
Gifts
Should you decline to accept the gift/s when they are offered, you will forfeit them and the Promoter will not be held liable. Please be aware that the gift/s may be subject to additional terms and conditions imposed by the supplier or the Promoter, including their validity period/s.
Please note that you will be responsible for any other costs associated with the gift/s that are not explicitly stated, such as mobile or data plans, installation expenses, and ongoing use.
The Promoter is not accountable for any disagreements that may arise between you and any individual with whom you decide to share or not share the gift/s.
In the event that the gift/s includes alcohol, it will be served in compliance with the responsible service of alcohol guidelines implemented by the Venue/Outlet’s staff and management. The Promoter is not responsible for the Venue/Outlet’s management and enforcement of these guidelines. The staff and management of the Venue/Outlet have the authority to refuse alcohol service to any gift winner/s or their companion/s who are deemed to be intoxicated.
General
If you or your claim violates these Terms and Conditions, the Promoter may discard your claim or all of your claims at the Promoter’s discretion. The Promoter reserves the right to request documentation from you to prove the validity of your claims, including documentation to establish your identity, age, place of residence, and place of employment. Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
You must not engage in any of the following actions: (a) tamper with the purchase process by using bots, scripts, or any other means to circumvent the process; (b) engage in any conduct that may jeopardize the fair and proper conduct of the offer; (c) act in a disruptive, annoying, threatening, abusive, or harassing manner; (d) do anything that may harm the reputation of the Promoter, its related entities, or the agencies or companies associated with the offer; (e) breach any law; or (f) behave inappropriately.
The Promoter may cancel the gift or restrict you and your companions from participating in any elements of the gift, at its discretion, if you or your companions, in the opinion of the Promoter (and/or a medical professional, as relevant to the circumstances), are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner that may harm the reputation of the Promoter, its related entities, or the agencies or companies associated with the offer, is contrary to law or is otherwise inappropriate.
The Promoter is not responsible for any misplaced, misdirected, delayed, lost, incomplete, illegible, or incorrectly submitted claims, gift claims, or correspondence, including failure of any third parties to forward claim forms for inclusion in the draw, where relevant.
If a dispute arises between you and the Promoter concerning the conduct of this promotion or claiming a gift, the Promoter will consider your point of view, taking into account any facts or evidence you put forward, and respond to it fairly within a reasonable time. The Promoter’s decision in connection with all aspects of this offer is final.
Gifts cannot be transferred or exchanged, except where cash is specified, nor redeemed for cash. All gifts (and elements of gifts) must be taken as and when specified, or will be forfeited with no replacement. The gift values are correct as of the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in gift value. If a gift (or element of a gift) is unavailable for any reason, the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.
If the offer cannot run as planned for any reason beyond the Promoter’s control, such as due to software, hardware, or communications issues, unauthorised intervention, tampering, fraud, technical failure, government directives, a pandemic, public health orders, or similar reasons, the Promoter may end, change, suspend, or cancel the offer or disqualify affected claims/claimants, subject to any necessary approval by the state/territory gaming authorities.
The Promoter is not responsible for any tax implications arising from you winning a gift. You should seek independent financial advice. If, for GST purposes, this offer results in any supply being made for non-monetary consideration,, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
Liability
These Terms and Conditions do not override or affect any consumer rights under applicable statutes, including the Competition and Consumer Act 2010 (Cth).
To the maximum extent permitted by law, the Promoter, as well as the associated agencies and companies, shall not be held liable (including for negligence) for any loss (including indirect, special or consequential loss, loss of profits), expense, damage, personal injury (including allergies, skin conditions, or other reactions), illness or death arising from participation in this offer or receipt of any gift, except for any liability which cannot be excluded under statute (in which case, the liability shall be limited to the greatest extent permitted by law).
Without limiting the previous paragraph, the Promoter and its associated agencies and companies shall not be liable for any loss of, damage to, or delay in the delivery of any gifts or any damage that occurs to displayed gifts.
